These Terms of Service (the "Terms") are an agreement between you and Dark Corner Creative, LLC, doing business as Dark Prison ("Dark Prison," "we," "us," or "our"). They govern your use of darkprison.com (the "Site"), your purchase of tickets, and your visit to the Dark Prison haunted attraction at 3301 E 5th St, Carson City, NV 89701 (the "Attraction"). By using the Site, buying a ticket, or entering the Attraction, you agree to these Terms. If you do not agree, do not buy a ticket and do not enter the Attraction.
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN ASSUMPTION OF RISK, A RELEASE OF LIABILITY THAT COVERS CLAIMS OF NEGLIGENCE, A CLASS ACTION WAIVER, AND A BINDING ARBITRATION PROVISION.
Tickets are sold through our third-party ticketing provider and may also be subject to that provider's terms. Prices, dates, and time slots can change until your purchase is complete. You are responsible for reviewing your order, including the event date and time slot, before checkout.
Your ticket is a revocable license. It grants one person one admission during the date and time slot shown, and nothing more. We may refuse admission, revoke your ticket, or remove you from the Attraction or its grounds at any time, for any lawful reason, without a refund. Tickets are personal and non-transferable, and tickets obtained through unauthorized resale or transfer are void. Once you exit the Attraction there is no re-entry without a new ticket.
All ticket sales are final. We do not offer refunds or exchanges for any reason, including arriving late, missing your time slot, choosing not to finish the Attraction, being removed or denied entry under these Terms, or deciding not to attend. If we cancel an event date, we may at our sole discretion offer admission on another date, but we are not obligated to issue a refund.
Event dates, hours, prices, attractions, entertainment, and experience details are subject to availability and may change or be canceled at any time without notice. We may delay, interrupt, or close the Attraction because of weather, power or equipment issues, safety concerns, capacity, or any other reason within or beyond our control. None of these changes entitles you to a refund.
Dark Prison is a haunted attraction designed to frighten. By entering, you acknowledge that the experience includes darkness, confined spaces, sudden loud noises, strobe lights, dense fog and haze, low clearances, uneven and low-visibility walkways, moving props and set pieces, costumed performers, intentional startle effects, and physical exertion. Performers will not intentionally grab you, but they may come extremely close, and incidental contact with performers, props, or sets may occur. Effects such as fog fluid, water, air blasts, and theatrical blood may contact, stain, or damage clothing and personal items, and you accept that risk.
You enter voluntarily and you knowingly assume all risks arising from your visit, whether known or unknown, foreseen or unforeseen, including the risk of personal injury, emotional distress, property damage, or death, to the fullest extent permitted by law. In these Terms, the "Released Parties" means Dark Corner Creative, LLC and its owners, members, managers, employees, agents, contractors, performers, volunteers, landlords, and sponsors.
To the fullest extent permitted by law, you release, waive, and discharge the Released Parties from any and all claims, demands, and causes of action arising out of or related to your visit to the Attraction or its surrounding grounds and parking areas, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. We may also require every guest to sign a separate liability waiver before entry, available at darkprison.com/waiver. Refusing to sign the waiver will result in denial of entry without a refund.
The Attraction is a public space with close quarters. You acknowledge the inherent risk of exposure to communicable diseases in any public place, you assume that risk, and you release the Released Parties from any claim related to illness contracted in connection with your visit.
You should not enter the Attraction if you are pregnant, have a heart condition, epilepsy or another seizure disorder, asthma or another respiratory condition, a recent surgery or injury, or any condition that could be aggravated by fright, strobe lights, fog, physical exertion, or confined spaces. Guests who enter with these or similar conditions do so at their own risk. We may refuse entry to any guest who appears intoxicated, impaired, or unwell, without a refund. If you feel unwell at any time, alert a staff member immediately. You consent to first aid and emergency medical treatment if our staff believe it is needed, and you are responsible for the cost of that treatment.
As a condition of entry, you consent to security screening, including bag inspection and metal detection. Refusing screening will result in denial of entry without a refund. The following are prohibited at the Attraction:
We may remove any guest who violates these rules or endangers other guests, performers, or staff, without a refund. Guests who strike, grab, or harass performers or staff, or who damage property, will be removed, will be liable for the harm they cause, and may be prosecuted.
Dark Prison may be too intense for young children. Parents and guardians are solely responsible for deciding whether the Attraction is appropriate for their minor children and for supervising them at all times. Minors remain the full responsibility of their parent or guardian throughout the visit, and these Terms, including the assumption of risk and release, apply to minors through their parent or guardian.
We are not responsible for lost, stolen, or damaged personal property, including items lost inside the Attraction. Parking areas are provided as a convenience. You park at your own risk, and we are not responsible for theft of or damage to vehicles or their contents.
We may photograph and record video and audio in and around the Attraction for security and promotional purposes. By entering, you grant the Released Parties a perpetual, worldwide, royalty-free right to use your image, likeness, and voice in any media, for any lawful purpose, without compensation or further consent.
You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your conduct at the Attraction, or damage or injury you cause.

The Site and the Attraction, including all logos, characters, set designs, audio, video, and written content, are owned by Dark Corner Creative, LLC or its licensors. You may not copy, distribute, or create derivative works from them without our written permission.
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, the total liability of the Released Parties for any claim arising out of these Terms, the Site, or your visit to the Attraction will not exceed the amount you paid for your ticket. The Released Parties are not liable for indirect, incidental, special, punitive, or consequential damages.
Any dispute arising out of these Terms or your visit that cannot be resolved informally will be resolved by final and binding arbitration in Carson City, Nevada, on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND DARK CORNER CREATIVE, LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Subject to the arbitration provision above, any dispute will be resolved in the state or federal courts located in Carson City, Nevada, and you consent to their jurisdiction.
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the Site or attendance at the Attraction after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. These Terms, together with our liability waiver, Privacy Policy, and SMS Terms & Conditions, are the entire agreement between you and us regarding the Site and your visit to the Attraction.
